Terms of Service

Last updated: April 2026

These Terms of Service ("Terms") govern your use of the WeScan scan-to-email relay service (the "Service") operated by WeScan ("we", "our", "us"). By signing up or using the Service, you agree to these Terms.

1. Service Description

WeScan provides an SMTP relay service that allows authorised multifunction printers and scanners to send scanned documents as email attachments to a whitelist of approved recipients. The Service consists of:

  • An SMTP relay server at smtp.wescan.net (port 587 with STARTTLS)
  • A web dashboard for managing recipients and credentials
  • Account authentication via email OTP or OAuth providers

2. Accounts

Registration

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your SMTP credentials. SMTP passwords are shown once at generation time — if lost, you must generate a new password.

Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement.

Account Termination

You may delete your account at any time by contacting us. We may suspend or terminate accounts for violation of these Terms, illegal activity, or extended inactivity (12+ months with no usage).

3. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited bulk emails, or commercial advertising
  • Send illegal, harassing, defamatory, or abusive content
  • Scan copyrighted material without authorisation
  • Attempt to bypass rate limits, authentication, or security controls
  • Use the Service in a way that degrades performance for other users
  • Relay email through our servers for purposes other than scan-to-email (e.g., general email sending, newsletter delivery)

Violation of these rules may result in immediate suspension without notice. We reserve the right to block specific senders, recipients, or content types.

4. Plans and Payments

Essential (Free) Plan

  • 5 whitelisted recipients
  • 5 MB file size limit
  • 10 emails per hour rate limit
  • For personal use only

Enterprise Plan ($20/month)

  • 100 whitelisted recipients
  • 25 MB file size limit
  • Unlimited emails (subject to fair use)
  • Priority support

Billing

Enterprise plans are billed monthly via Stripe. Payment is due at the start of each billing period. Refunds are provided on a case-by-case basis for service outages exceeding 24 hours. You may downgrade to the Free plan at any time — downgrades take effect at the end of the current billing period.

5. Service Level

We aim for 99.9% uptime but do not guarantee uninterrupted service. The Service is provided "as is" without warranty of any kind. We are not liable for lost scanned documents, failed deliveries, or any indirect damages arising from use of the Service.

In the event of a service outage, we will restore service as quickly as possible. Enterprise plan users will receive priority restoration.

6. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, our total liability for any claim arising from these Terms or the Service is limited to the amount you have paid us in the 12 months preceding the claim. We are not liable for:

  • Loss of data or documents
  • Delayed or failed email delivery
  • Damages caused by third-party services (Mailgun, Stripe, Cloudflare)
  • Consequential or incidental damages

7. Privacy

Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you consent to the practices described in that policy.

8. Modifications

We may modify these Terms at any time. Material changes will be notified via email to the address associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms shall be resolved in the courts of Sydney, New South Wales.
